End-User License Agreement (EULA)

This End-User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("User," "you," or "your") and IMR Creations LLC ("Licensor," "we," "us," or "our") governing your use of the HomeMap mobile application and web service ("App" or "Software"). By downloading, installing, accessing, or using the App, you agree to be bound by the terms of this EULA.

If you do not agree to this EULA, do not download, install, or use the App.

1. License Grant

Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use in accordance with this EULA and our Terms of Service.

2. License Restrictions

You agree that you will NOT:

Copy or Duplicate: Copy, reproduce, duplicate, or replicate the App, its source code, object code, interface, design, or any portion thereof, except as a single backup copy for archival purposes where permitted by law.
Modify: Modify, alter, adapt, translate, or create derivative works based on the App or any portion of it.
Reverse Engineer: Reverse engineer, decompile, disassemble, decrypt, or attempt to derive the source code, underlying algorithms, data structures, or ideas from the App, except to the extent that such restriction is expressly prohibited by applicable law.
Resell or Redistribute: Sell, resell, rent, lease, lend, sublicense, distribute, or otherwise commercially exploit the App or access to it.
Transfer: Transfer, assign, or delegate your license or any rights under this EULA to any third party without our prior written consent.
Remove Notices: Remove, alter, conceal, or obscure any copyright, trademark, patent, or other proprietary notices, labels, or marks on the App.
Circumvent: Circumvent, disable, or interfere with any security, digital rights management, or access control features of the App.
Scrape or Extract: Use any automated means (bots, scrapers, crawlers) to access, extract, or copy data from the App.
Compete: Use the App or its design, features, or concepts to build a competing product or service.

3. Intellectual Property

The App and all copies thereof are the exclusive property of IMR Creations LLC. The App is protected by copyright laws, international copyright treaties, and other intellectual property laws and treaties. All rights, title, and interest in and to the App, including but not limited to:

Source code and compiled code
User interface design and user experience
Graphics, icons, logos, and visual elements
Algorithms and business logic
Documentation and related materials
Trademarks and trade names (including "HomeMap" and the HomeMap logo)

are and shall remain the sole and exclusive property of IMR Creations LLC. This EULA does not grant you any ownership rights to the App.

4. User-Generated Content

You retain all ownership rights to content you create or upload through the App (including photos, text, data, and records). However, by using the App, you grant us a limited license to process, store, and display your content solely to provide the App’s services to you and your authorized collaborators. We claim no ownership over your content.

5. Third-Party Components

The App may include open-source software components or third-party libraries, each governed by their respective license terms. A list of such components and their licenses is available upon request. Nothing in this EULA restricts your rights under those open-source licenses.

6. Updates & Modifications

We may release updates, patches, or new versions of the App from time to time. Some updates may be required for continued use.
Updates are subject to this EULA unless a new EULA is provided with the update.
We reserve the right to modify, suspend, or discontinue the App (or any feature thereof) at any time, with or without notice.

7. Subscription & Payment Terms

Certain features of the App require a paid subscription. Subscription terms, pricing, billing, and cancellation are governed by our Terms of Service (Section 4). This EULA applies regardless of whether you use the free or paid version of the App.

8. Data Protection & Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your data. By using the App, you acknowledge that you have read and understood our Privacy Policy.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.
We do not warrant that the App will meet your specific requirements.
We do not warrant the accuracy, reliability, or completeness of any information obtained through the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IMR CREATIONS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

Our total aggregate liability under this EULA shall not exceed the amount you paid for the App in the twelve (12) months preceding the event giving rise to the claim, or fifty US dollars ($50.00), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless IMR Creations LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the App, your violation of this EULA, or your infringement of any third-party rights.

12. Term & Termination

This EULA is effective from the date you first download, install, or use the App and continues until terminated.
You may terminate this EULA at any time by uninstalling the App and deleting all copies.
We may terminate this EULA immediately if you breach any of its terms.
Upon termination, all rights granted to you under this EULA cease immediately. You must stop using the App and delete all copies.
Sections that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) shall survive.

13. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including US Export Administration Regulations, and you will not transfer the App to any prohibited country, entity, or person.

14. Government End Users

If the App is acquired by or on behalf of a unit of the US Government, the Software is deemed "commercial computer software" and "commercial computer software documentation" and the Government's rights are limited to those described in this EULA, per 48 C.F.R. §12.212 or 48 C.F.R. §227.7202.

15. Governing Law

This EULA is governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. For users outside the United States, mandatory consumer protection laws of your jurisdiction apply where they cannot be waived by agreement.

16. Severability

If any provision of this EULA is found to be invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid.

17. Entire Agreement

This EULA, together with our Terms of Service, Privacy Policy, and Data Deletion Policy, constitutes the entire agreement between you and IMR Creations LLC with respect to the App. This EULA supersedes all prior agreements and understandings regarding the App.
